Since 1998, all regions and all relevant departments have conscientiously implemented the “Notice of the State Council on Deepening the Reform of the Fertilizer Distribution System” (Guo Fa [1998] No. 39), actively and steadily pushed forward the reform of the chemical fertilizer circulation system, and the chemical fertilizer industry has continued to develop rapidly. . In order to further deepen the reform of the chemical fertilizer distribution system, mobilize the enthusiasm of all parties involved in the management of fertilizers, continuously improve the level of agricultural services, and meet the needs of agricultural production development, the following decisions are now made:

I. Releasing fertilizer business restrictions

Remove the restrictions on the nature of the ownership of chemical fertilizer business enterprises, allow qualified market entities with various ownership and organization types, farmer professional cooperatives and individual industrial and commercial households to enter the fertilizer circulation field, participate in operations, and compete fairly. Enterprises that apply for chemical fertilizer operations must have corresponding residences, and individual industrial and commercial households applying for chemical fertilizer operations must have corresponding business sites; the registered capital of enterprises (gold) and individual industrial and commercial households must not be less than 30,000 yuan. Enterprises that apply for establishing branches and engaged in chemical fertilizer management within the province's boundaries. The registered capital of the company's headquarters (gold) shall not be less than 10 million yuan. Enterprises that apply for establishment of branches across the province, engaged in fertilizer operations, and corporate headquarters The registered capital (gold) must not be less than 30 million yuan***. Enterprises, individual industrial and commercial households that meet the requirements for registered capital (gold) and amount of funds may apply directly to the local industrial and commercial administrative department for registration and engage in chemical fertilizer business. If an enterprise engages in the chain operation of chemical fertilizers, it may hold relevant documents and registration materials of the chain business of the company’s headquarters and go directly to the administrative department of industry and commerce in the place where the store is located to apply for registration.

Second, standardize business operations

Fertilizer operators shall establish a purchase acceptance system, a cable claim verification system, a purchase invoice and a sales ledger system, and relevant records must be kept for two years after the sale of chemical fertilizers for inspection. Fertilizer operations should be clearly priced, and the packaging and labeling of chemical fertilizers must comply with relevant laws and regulations and national standards. Fertilizer producers and operators must not be adulterated or adulterated in chemical fertilizers, and they must use counterfeit goods, shoddy goods, or unqualified goods as quality goods. Fertilizer operators must be responsible for the quality of the fertilizers they sell, and they should proactively issue quality assurance certificates when they sell them. If there are quality problems with chemical fertilizers, consumers can claim the sellers according to the quality assurance certificate. Fertilizer operators should master basic fertilizer business knowledge and should actively provide chemical fertilizer users with relevant consulting services such as chemical fertilizer characteristics, use conditions and methods.

Third, encourage chain intensive management

The state encourages large-scale fertilizer production and circulation enterprises and social capital with a certain strength and scale to integrate resources and develop chain and intensive operations through mergers and acquisitions. For the construction and improvement of regional fertilizer trading market and fertilizer reserves, operations and modern logistics facilities, governments at all levels must actively support them. The fertilizer trading market should establish and improve the quality management system of fertilizer products, constantly improve the trading rules, and effectively protect the legitimate rights and interests of customers.

Fourth, strengthen market supervision and management

All regions and relevant departments must earnestly strengthen market supervision after the release of chemical fertilizer operations. The agricultural sector shall regularly supervise and random check the fertilizers that may endanger the quality and safety of agricultural products, and announce the results of spot checks. Quality inspection departments should strengthen the supervision of the quality of fertilizer production sources, strengthen inspections, and severely investigate and punish acts such as insufficient effective content, adulteration, logo fraud, and measurement violations. The industrial and commercial departments should strengthen the supervision of the main body of chemical fertilizer operations, increase the investigation and punishment of sales of counterfeit and deteriorating fertilizers, and false advertisements, and urge the operators to establish and improve the system of purchasing and selling ledgers and cable claims, and carry out credit classification in the fertilizer market. Supervision, promote the construction of the fertilizer market credit system. The price department must strengthen the investigation of behaviors such as driving up prices, collusion of price increases, price fraud, and failure to specify prices clearly. The customs system must crack down on chemical fertilizer smuggling. All relevant departments must strengthen the sharing of information, coordinate the counterfeiting of agricultural resources, and improve administrative efficiency. It is necessary to vigorously popularize the knowledge of chemical fertilizers, improve the ability of the peasants to defend their rights, and open channels for reporting complaints. We must establish and improve relevant laws and regulations and strengthen supervision and management in accordance with the law. Local people's governments at all levels must maintain a fair market order and resolutely eliminate local protectionism.
