**Abstract**
On the 24th, China’s highest legislative body passed the most comprehensive environmental law amendments in its history. The revised Environmental Protection Law will come into effect on January 1 of next year, marking a significant step forward in addressing the country's long-standing environmental challenges. As the world’s second-largest economy, China has been grappling with severe pollution and ecological degradation, which have become major concerns for public health and sustainable development. This new law is expected to provide stronger legal support for environmental protection and help reverse the negative impact of rapid industrialization.
After four rounds of review, the amendment was officially approved by the Standing Committee of the 12th National People’s Congress. Environmental experts believe that this updated law may be the most stringent administrative regulation in the environmental field today. It strengthens government accountability, improves core environmental systems such as pollution control, monitoring, and impact assessments, and introduces stricter penalties for violations. Additionally, it promotes transparency, public participation, and environmental information disclosure, making the law more enforceable and practical.
The previous Environmental Protection Law, which had been in place for 25 years, was increasingly seen as outdated and ineffective in addressing modern environmental issues. The law lacked strong enforcement mechanisms, leading to weak implementation and persistent pollution problems. Moreover, the traditional growth model focused too heavily on GDP, resulting in widespread air, water, and soil pollution that threatens public health and social stability.
In recent years, several "green-related mass incidents" have occurred in cities like Xiamen, Dalian, and Sichuan, highlighting growing public concern over environmental issues. Illegal wildlife hunting and unsafe food products have also sparked widespread anxiety among citizens. These events underscore the urgent need for institutional reforms and stronger legal frameworks to address environmental fears and restore public trust.
Experts suggest that environmental governance should be integrated into a comprehensive and long-term system. The 18th National Congress of the Communist Party of China introduced the concept of "Beautiful China" and emphasized ecological civilization. In the Third Plenary Session of the 18th CPC Central Committee, ecological construction became a key reform priority, aiming to achieve a harmonious relationship between humans and nature.
As China moves toward a well-rounded moderately prosperous society, it has launched a series of comprehensive reforms. Officials like Gao Jixi from the Ministry of Ecology and Environment emphasize the importance of integrating urban planning, industrialization, and agricultural modernization to prevent pollution at its source. Cao Xianghong, an academician of the Chinese Academy of Engineering, calls for price reforms in energy sectors to ensure polluters bear higher costs.
With the new law, the Ministry of Environmental Protection will gain more authority to impose strict penalties, including shutting down polluting factories and confiscating equipment. The establishment of ecological red lines will also prevent polluting industries from operating in sensitive areas. The law also enhances public awareness, protects whistleblowers, and expands the scope of environmental public interest litigation, encouraging greater citizen involvement in environmental protection.
China's environmental legal framework includes over 30 relevant laws and 90 administrative regulations. As the cornerstone of environmental governance, the revised law will help create a “system cage†for ecological civilization, supporting the vision of a cleaner, healthier, and more sustainable China.
